Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and CristOS Dev, LLC ("CristOS," "we," "us") governing your use of the CristOS app and website. By creating an account or using CristOS, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use CristOS.

Eligibility and your account

You must be at least 18 years old to use CristOS. You are responsible for the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly at support@cristosdev.com if you suspect unauthorized access. You must provide accurate account information and keep it current.

The CristOS service

CristOS provides tools to create and manage projects, assign and track work, upload and organize documents, message teammates, invite collaborators, use AI and voice assistance, and coordinate meetings and project activity. We may add, change, or remove features over time. We aim for high availability but do not guarantee that CristOS will be uninterrupted or error-free.

Acceptable use

You agree not to use CristOS to:

• Send spam, conduct unauthorized outreach, or harass, threaten, or abuse others.
• Violate any law or regulation, or infringe the rights of others.
• Upload malicious code or attempt to disrupt, probe, or gain unauthorized access to the service or other accounts.
• Use the service to make unauthorized communications, or to contact people who have not consented to be contacted.
• Misrepresent your identity or your authority to act for an organization.

You are solely responsible for outreach, calls, and messages you initiate through CristOS, including ensuring you have any consent required to contact recipients.

User content and project content

You retain ownership of the content you and your collaborators submit to CristOS, including projects, documents, messages, and other materials ("Content"). You grant us a limited license to host, store, process, transmit, and display your Content solely to operate and improve CristOS and provide it to you and the collaborators you authorize.

You are responsible for your Content and for having the rights necessary to submit it. You must not upload Content you do not have the right to share. Collaborators you invite may be able to view and act on shared project Content.

AI features and outputs

CristOS includes AI features that generate summaries, suggestions, transcripts, extractions, and assistant actions. AI outputs are assistive and may be inaccurate or incomplete. You are responsible for reviewing AI-generated content and decisions before relying on or acting on them. Do not rely on CristOS as a sole source of truth for important, legal, financial, medical, or safety-related decisions.

No emergency use

CristOS is not an emergency service. Do not use CristOS, its notifications, calls, or messages to request or provide emergency help. If you have an emergency, contact your local emergency services directly. We do not guarantee that any message, call, or notification will be delivered, received, or acted on in time.

Phone and SMS communications

CristOS can place AI-assisted phone calls after you confirm them in the app, and may offer optional SMS notifications. SMS is never required to use CristOS. Enrolling in SMS requires a separate, explicit opt-in, and you can opt out at any time. Standard message and data rates may apply. See our SMS Terms and SMS opt-in overview.

Third-party services

CristOS relies on third-party providers (including Supabase, Twilio, Apple, OpenAI, Anthropic, ElevenLabs, and an email provider) to deliver its features. Your use of CristOS may also be subject to those providers' terms. We are not responsible for third-party services we do not control, and their availability may affect CristOS.

Paid features, templates, and marketplace

CristOS may offer paid features, templates, or a marketplace (for example, project templates in the Market area). If you purchase or sell such items, additional terms, fees, and eligibility requirements may apply and will be presented at the point of purchase. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing prospectively with notice.

Our intellectual property

CristOS, including its software, design, and trademarks, is owned by CristOS Dev, LLC and its licensors and is protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use CristOS as permitted here. You may not copy, modify, reverse engineer, or create derivative works of CristOS except as allowed by law.

Suspension and termination

You may stop using CristOS and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or for prolonged inactivity, generally with notice where practicable. On termination, your right to use CristOS ends, and we will handle your data as described in the Privacy Policy.

Disclaimers

CristOS is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that CristOS will be uninterrupted, secure, error-free, or that AI outputs will be accurate.

Limitation of liability

To the maximum extent permitted by law, CristOS Dev, LLC and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of CristOS. To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid us for CristOS in the twelve months before the claim or USD 100.

Indemnification

You agree to indemnify and hold harmless CristOS Dev, LLC and its providers from claims, losses, and expenses (including reasonable legal fees) arising from your Content, your use of CristOS, your outreach or communications, or your violation of these Terms or applicable law.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Collier County, Florida, and you consent to their jurisdiction, except where applicable law provides otherwise.

Changes to these terms

We may update these Terms from time to time. When changes are material, we will update the "Last updated" date and provide notice where appropriate. Continued use of CristOS after an update means you accept the revised Terms.
